On 11.9.2023, the Firm's Partner, Dawn Wong, was invited to conduct a webinar entitled "Performance Bonds 101" for MMC Corporation Berhad.
Dawn shared her views on the factors to consider before making a demand on a performance bond, the common risks and pitfalls to be wary of, and the grounds under which a demand can successfully be restrained.
Dawn also discussed the competing policy considerations that the Courts will likely consider when deciding whether to grant injunctive relief, as well as the ramifications of a beneficiary assigning the rights and interests in a performance bond to a third party based on the recent decision of the Court of Appeal in Damai City Sdn Bhd v. MCC Overseas (M) Sdn Bhd and other appeals [2023] 1 MLJ 258 (CA).
